Per Report:
AT APPROXIMATELY 2324 HOURS, I, OFFICER LAFAVE, WAS ON DUTY IN FULL UNIFORM DISPLAYING MY BADGE OF OFFICE, AND IN A MARKED NMSP PATROL VEHICLE WITHIN THE COUNTY OF BERNALILLO STATE OF NEW MEXICO. AT THIS TIME, I WAS TRAVELING NORTH ON THE FRONTAGE ROAD APPROACHING MENAUL WHEN I OBSERVED A GRAY TRUCK STOPPED IN LANES 2 AND 3 WITH ITS HAZARD LIGHTS ACTIVATED. I ACTIVATED MY EMERGENCY EQUIPMENT AND PULLED DIRECTLY BEHIND THIS VEHICLE. I EXITED MY PATROL CAR AND MADE CONTACT WITH THE FEMALE DRIVER, LATER IDENTIFIED AS MONICA FELIX (DEFENDANT) AND ASKED WHAT HAPPENED.
DEFENDANT STATED SHE BELIEVED HER CLUTCH WENT OUT, WHILE SHE DEPRESSED THE CLUTCH IN AN ATTEMPT TO START THIS VEHICLE. I COULD SEE THE VEHICLES KEYS WERE IN THE IGNITION. WHILE SPEAKING WITH DEFENDANT I SMELLED THE STRONG ODOR OF AN ALCOHOLIC BEVERAGE FROM DEFENDANT BREATH AS HE SPOKE AND/OR VEHICLE; EYES WERE BLOODSHOT, WATERY AND HER SPEECH WAS SLURRED. I ASKED DEFENDANT TO EXIT HER VEHICLE AND SHE ASKED WHY SEVERAL TIMES. HER SPOUSE/FRIEND SHOWED UP, REMOVED THE VEHICLES KEYS FROM THE PASSENGER SIDE AND DEFENDANT EXITED THIS VEHICLE. ONCE DEFENDANT WAS OUTSIDE THIS VEHICLE, I CONTINUED TO SMELL THE STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM HER BREATH AS HE SPOKE AND ASKED DEFENDANT HOW MUCH HE HAD BEEN DRINKING.
DEFENDANT INITIALLY DENIED BEFORE ADMITTING TO DRINKING EARLIER THIS DATE. I ASKED DEFENDANT WHERE SHE WAS COMING FROM AND SHE STATED SHE DROVE FROM THE SAN JOSE AREA AND WAS HEADING HOME WHEN HER VEHICLE BROKE DOWN. BASED ON MY OBSERVATIONS, I ATTEMPTED TO HAVE DEFENDANT SUBMIT TO A SERIES OF STANDARDIZED FIELD SOBRIETY TESTS (SFST’S). DEFENDANT REFUSED ALL SFST’S. BASED ON MY TRAINING, EXPERIENCE AND OBSERVATIONS, I OBSERVED DEFENDANT TO DISPLAY SIGNS OF IMPAIRMENT AND I DETERMINED HE WAS UNABLE TO CONTINUE TO OPERATE A MOTOR VEHICLE SAFELY

Police officers should have the right to drag a piece of trash like that out of the car by their hair!!!! A victim of domestic abuse or a home invasion could be waiting for help while this puerile drunk loser is wasting time being non compliant!! This is the perfect example of human refuse. That officer has the patience of a saint, I would have given her a good shove when a truck was going by.

She made the same mistake as alot of people the keys are most likely in the lgnition, and she is in the driver seat. A buddy went to a party and he was wasted so he just slept in his car on the street and the cops were called out for something to do with the party and they saw him and woke him up and started asking all these questions and was doing a field sobriety test and then he asked one question that stopped it all and started walking around and shortly left telling him to go back to sleep and have a good night. He said " How can I be charged with DUI and I was asleep in the back seat, and the keys are outside of the car?" The cops verified the keys by getting them and started the car up for a second
