MIAMI – The man accused of driving the wrong way on the Palmetto Freeway and causing a fatal accident faced a South Florida judge on Tuesday.
Maiky Simeon was originally given a $50,000 bond and house arrest.
On Tuesday, prosecutors argued that he should be rearrested and the judge agreed, drawing applause from the courtroom.
It was in the early morning hours of Saturday, August 20, when police say Simeon was driving the wrong way on the Palmetto Expressway before colliding head-on with a car, killing all five youths inside.
During Tuesday’s hearing, it was revealed that Simeon’s blood alcohol content was well above the legal limit at the time and that he was speeding, doing 80 mph at the time of impact.
Simeon’s attorney said he has been in South Florida for more than a decade while trying to convince the judge that his client is not a flight risk and should be allowed to stay out of jail, instead with house arrest.

“He doesn’t have any travel documents, he has good family support,” argued attorney Albert Levin.
The judge disagreed, ordering that Simeon be placed in preventive detention.
The dozens of family members of the victims who were in court told Local 10 News they were relieved by his decision.
“This is a very difficult time for our family and we are truly grateful that justice is being done,” said Aealver Ávila, the victim Briana Pacalagua.
Family members of the victims were very upset afterward, saying that this has been an incredibly difficult time for them.
Simeon is now back in custody, and will be in jail until his trial begins.
