Restrictive covenants are sometimes used to specify what a piece of land can be used for, so that the value and enjoyment of adjoining land will be preserved. However in the not-so-distant history, these clauses were used to define what race of people were permitted to purchase – or even visit – a certain piece of land.

In Canada, these kind of covenants were challenged when a Jewish businessman from London, Ontario, wanted to purchase a property in Beach O’ Pines, a private gated community of holiday homes in Ontario. This case eventually went all the way to the Supreme Court of Canada, and it was a major catalyst towards removing racist covenants and zoning in Canada.

  1. interestingly, such a restriction also goes against 'property rights'.
    after all if you can't choose who to sell to do you really own a thing?

    the racism angle is bad enough, but to think that you get to dictate terms like that to someone who is buying from you and you likely hid such a clause deep in the contract instead of saying it upfront.

  2. Bigotry exists in every country, it just varies in what groups that culture doesn't accept. Fortunately, at least in North America, it seems to be waning as each generation is more tolerant and laws make it harder to discriminate. Unfortunately, there is still a long way to go.

  5. Oh Boy , just imagine if it was that easy to exclude a race. The original people could've written a covenant to exclude Europeans , then most Europeans would still be living caves .

  6. I don't know why so many people look at these stories with a negative light. I look at it and think how great it as that the law and people ensured that this stupid restriction was taken away rather than look at what happened in the 1930s as if its happening right now.

  7. The fact that at one point someone wrote all this down and enough people around them agreed that it became an enforceable restriction always helps bring me down when I’m feeling a bit too good about the human race

From the country of residential schools, turning away ships of refugees back in the day, and secretly funding the slave holding southerners of the USA as a way to keep USA from trying to attack again. Sigh. Oh I forgot skilled decoy unions, a prime minister who union busted for USA mining tycoons and then was a consultant for pre war Germany on undermining socialists.

  11. So in other words it has been made federally illegal to discriminate in Canada 🇨🇦. If you’re a Canadian under the age of 31, you and I have had the privilege of living with this legislative protection our whole life.
